- Palestinian NGOs Reject EU Aid over Refusal to Renounce Tiesto Terrorism
135 Palestinian NGOs refuse to sign 2020 EU grant agreement over amendment calling fororganizations to refute ties to terrorism, claim terrorist groups are “political parties”. Jerusalem, Israel─ December 31, 2019─ Over 130 Palestinian organizations have refused tosign an EU grant request which stipulates among its criteria that beneficiaries must refuse totransfer any EU aid given to terrorist groups or entities.1 The organizations in questionsteadfastly decline to do so, claiming Palestinian terrorist groups are merely “politicalparties”. Shawan Jabarin, the executive director of the Palestinian boycott organization Al-Haq toldthe media outlet The New Arab, "We demanded to include conditions stipulating that we donot have to recognize the criteria listed regarding terror groups".2 A letter of protest was latersent to a meeting between EU representatives in the Palestinian Authority and representativesof Palestinian civil society organizations, led by Mustafa Barghouti, secretary-general of thePalestinian National Initiative, and Jabarin. In recent years, the Ministry of Strategic Affairs has been revealing the shared ties betweensupposed Palestinian human rights organizations and terrorist groups. In its report releasedearly this year, “The Money Trail”, along with additional findings from organizations such asNGO monitor, it was found that EU institutions have awarded millions of euros in financialaid to Palestinian civil society organizations which have ties to terrorist entities and promoteboycotts against Israel. Additionally, in the ministry’s "Terrorists in Suits" report, over 100 ties shared between BDSorganizations and internationally designated terrorist groups were found, including the PFLPand Hamas. According to the report, so-called Palestinian civil society organizations act asmedium for funds for terrorist entities, enabling them to raise money for their activitiesthrough legitimate bodies including the EU. The opposition of these organizations to criteriapreventing the transfer of funds to terror related activities proves the report's claim. An Israel Security Agency investigation into the August 2019 “Ein Bubin” bombing, whichresulted in the murder of 17-year-old Rina Shnerb and injury of her brother and father, some50 PFLP terrorists were arrested. The PFLP is designated as a terrorist group by the EU, US,Canada and Israel. Those detained included senior ocials who served in Palestinian "civilsociety" organizations including one of the 135 Palestinian NGOs,Addameer. Addameer is an organizations which, alongside its ongoingcampaign to boycott and delegitimize the State of Israel, calls for therelease of PFLP terrorists while providing them legal representation. #WorldNews #News

Her father and elder brother who were with her were both seriously wounded. Rina Shnerb (17) a resident of Lod, was murdered today (Friday, 23 August 2019) when terrorists detonated an improvised explosive device (IED) planted at a natural spring that is a popular tourist and recreational site located near the West Bank settlement of Dolev. Police sappers determined that the bomb had been planted earlier at the spring and was triggered remotely when the family approached it. Rina, her father and brother were on a hiking trip in the area. Rina attended a religious high school for girls in Lod and was an instructor for the Bnei Akiva religious Zionist youth movement. Her father, Eytan (46), also wounded in the blast, is a rabbi and the father of 11 children. Rina's brother Dvir (19), who was with them on the hike and wounded as well, attends a religious school in the settlement of Eli in the West Bank. The Shnerb family runs a charity center that provides clothes and food to hundreds of impoverished families. Due to Eytan's charity work in Lod, he was chosen to light a torch at Israel's 63th Independence Day ceremony. This year, the event was compered by Esther Ada and Eurovision winner Neta Barzilai will perform. During the event, Ahiya Emanuel Fisher, brother of Adva Fisher ז"ל who was killed in a suicide attack in 2003, spoke on behalf of the children. The Chair of the Organization of Victims of Terror Abie Moses and Director General of the National Insurance Institute Meir Spiegel also spoke at the event. The Organization of Victims of Terror has held Bar and Batmitzvah celebrations for the last 18 years. Ahiya Emanuel Fisher, a bereaved brother who lost his sister Adva in 2003 in a suicide attack, spoke of his loss. “We are all kids who have grown up, but our growing up started long before we got to the age of Barmitzvah,” he said. “From the pictures and stories I have got to know Adva, the light she brought to our home. I am sure she is proud of me from above,” he added. Adva Fisher was murdered in 2003 when she was 19 years old in a terrorist attack at the Geha junction. Two and a half years later, her brother Ahiya Emanuel was born. At his Barmitzvah, Ahiya chose to donate all the gifts he received to people with special needs, in her memory. The president spoke to the young people and said, “Today, you mark the transition from childhood to adulthood, the age when young men and women form their own opinions, come of age in the eyes of religion and are expected to take responsibility for their actions. You have all, unfortunately, already experienced the loss of a father, mother, brother, sister or other relative. Some of you have been injured yourselves. Already as children, too soon, you were asked to grow up, and you did. I want to say that you became heroes. When I see you here, strong, bright and smiling, when I see your spirit, I feel that you are the ones who give me strength.” He added, “On this emotional day, the people of Israel are with you. - Israel's Attorney General is publishing today his legal opinion regarding the ICC's lack of jurisdic
he following is a statement from the Attorney General: For several years now, the Office of the Prosecutor at the International Criminal Court (ICC) has been conducting a preliminary examination further to a request submitted by the Palestinians. The principled legal position of the State of Israel, which is not a party to the ICC, is that the Court lacks jurisdiction in relation to Israel and that any Palestinian actions with respect to the Court are legally invalid. A year ago, I announced that I was considering publishing a reasoned opinion regarding the Court's lack of jurisdiction to deal with the Palestinian request, with a view to making public Israel's position in this regard as presented in various legal and diplomatic fora. In light of the Prosecutor's recent statement, in the context of her annual report on preliminary examinations (5 December 2019), noting her intention to reach a decision in the matter, I consider it appropriate to publish the paper at this time. As set out in detail in the opinion, the Court manifestly lacks jurisdiction for the following reasons: Only sovereign states can delegate criminal jurisdiction to the Court. The Palestinian Authority clearly does not meet the criteria for statehood under international law and the Court's founding Statute. The claim that the Palestinians have purported to join the Rome Statute does not meet, nor can it replace, the substantive test requiring criminal jurisdiction to have been delegated to the Court by a sovereign state with a defined territory. Israel has valid legal claims over the same territory in relation to which the Palestinians are seeking to submit to the Court's jurisdiction. Israel and the Palestinians agreed, with the support of the international community, to resolve their dispute over the future status of this territory in the framework of negotiations. By approaching the ICC, the Palestinians are seeking to breach the framework agreed to by the parties and to push the Court to determine political issues that should be resolved by negotiations, and not by criminal proceedings. The Court was not established for such purposes, nor does it have the authority or capacity to determine such matters, especially in the absence of the consent of the parties. The paper published today sets out my opinion solely with respect to the Court's lack of jurisdiction. Subject to future developments, I may consider addressing additional issues related to this matter. The paper is the product of a collaborative inter-agency effort, including personnel from the Ministry of Justice, the Ministry of Foreign Affairs, and the National Security Council, headed by the Deputy Attorney General for International Law, Dr. Roy Schondorf, and the Legal Advisor of the Ministry of Foreign Affairs, Dr. Tal Becker; in full coordination with Israel's senior political echelon. #Israel #WorldNews #IsraelNews
